Terms And Conditions
1. Scope#
These "Terms and Conditions of Use" govern the terms and conditions of access and use of the "Poverty Stoplight" platform by any user or third party (provider, collaborator, or licensee) in its web or app modalities owned by Fundación Paraguaya de Cooperación y Desarrollo, RUC 80004571-8, located at Manuel Blinder 5589 c/ Tte. Espinoza, Asunción, Paraguay, contact email dpo@povertystoplight.org, and contact phone 59521609277.
From the moment the user or third party accesses Poverty Stoplight or any of its resources, they fully and unreservedly accept every provision included in these Terms and Conditions of Use. Therefore, it is recommended that the user reads them carefully each time they intend to enter or use any of Poverty Stoplight's resources. Consequently, the user should not continue to use it if they do not accept the terms and conditions detailed below.
2. Availability of Information and Services#
Users and third parties (hereinafter, jointly referred to as "users" unless it is necessary to distinguish them separately to emphasize a specific obligation) can access different types of information and services through Poverty Stoplight. Fundación Paraguaya de Cooperación y Desarrollo reserves the right to modify, at any time and without prior notice, the presentation and configuration of the information and services offered by Poverty Stoplight. In this regard, the user expressly acknowledges and accepts that at any time Poverty Stoplight may interrupt, deactivate, and/or cancel any information or service.
In this regard, Fundación Paraguaya de Cooperación y Desarrollo does not guarantee the continuous and permanent availability of services, thus exempting itself from any responsibility for possible damages caused due to the unavailability of the service for the following reasons:
Force majeure or errors in the telematic networks of data transfer or storage (servers), beyond its control.
Disconnections made for improvement or maintenance work on computer equipment and systems.
Modifications in the presentation and configuration of the information and services are described in the previous paragraph.
In all the above cases, Fundación Paraguaya de Cooperación y Desarrollo will make its best efforts to notify about the possible lack of availability of the services, as well as to restore the services to their full availability.
3. User and Third-Party Obligations#
Expressly, the user declares that they will use Poverty Stoplight diligently and will assume any responsibility that may arise from the breach of these Terms and Conditions of Use.
In this regard, the user agrees to fulfill the following obligations:
Not to use Poverty Stoplight for activities contrary to the law, morality, and public order, as well as for prohibited purposes or that violate or harm the rights of third parties.
In cases where data or information is requested, do not falsify their identity by impersonating any other person.
Not to disseminate, store, and/or manage data or content that infringes on the rights of third parties or any regulations governing intellectual or industrial property rights.
Not to transmit, store, disclose, promote, or distribute data or content that carries viruses or any other computer code, files, or programs designed to interrupt, destroy, or harm the operation of any computer program or telecommunications equipment.
Not to use the contents of the portal to send advertising, communications for direct sales purposes, or any other commercial purpose, unsolicited messages addressed to a plurality of people regardless of their purpose, as well as to refrain from marketing or disclosing such information in any way.
Fundación Paraguaya de Cooperación y Desarrollo may, at its sole discretion, deny, withdraw, suspend, and/or block access to information and services at any time and without prior notice to users who violate these Terms and Conditions of Use.
The user undertakes to indemnify and hold Fundación Paraguaya de Cooperación y Desarrollo harmless for any damage, harm, sanction, fine, penalty, or compensation that Fundación Paraguaya de Cooperación y Desarrollo may have to face as a result of the user's breach of the obligations contained in these Terms and Conditions of Use.
4. Links to Other Websites#
Fundación Paraguaya de Cooperación y Desarrollo does not guarantee or assume any responsibility for damages suffered by accessing third-party services through connections, links, or links from linked sites, nor the accuracy or reliability of them. The function of the links provided is solely to inform the user about the existence of other sources of information on the Internet, where they can expand the services offered by the platform.
Fundación Paraguaya de Cooperación y Desarrollo will not be responsible in any case for the result obtained through such links or the consequences arising from users' access to them. These third-party services are provided by them, so Fundación Paraguaya de Cooperación y Desarrollo cannot control the legality of the services or their quality. Consequently, the user must exercise caution in the assessment and use of the information and services existing in the contents of third parties.
5. Intellectual and Industrial Property#
The works and creations offered on Poverty Stoplight (texts/documentation, survey contents, images, photographs, graphics, icons, logos, technology, graphic design, source code, registered and unregistered trademarks, domain names, other distinctive signs, and, in general, any type of work or creation included in the platform or used to identify it or parts of it) are subject to intellectual and industrial property rights owned by Fundación Paraguaya de Cooperación y Desarrollo and, where appropriate, the license-holding organizations of the "Semáforo" brand.
Reproduction or transmission in any form or by any means of all or part of the content of the works and creations offered on Poverty Stoplight is not allowed. Similarly, the source code may not be copied, modified, or decompiled by reverse engineering or any other technique for that purpose.
For the partial or total reproduction, as well as for the exploitation, distribution, and commercialization in general of Poverty Stoplight (design, programming, editing, compilation, and other elements necessary for its operation), express and written authorization from Fundación Paraguaya de Cooperación y Desarrollo is required.
Any infringement of the provisions in this section will be considered a violation of the intellectual or industrial property rights owned by Fundación Paraguaya de Cooperación y Desarrollo and, where appropriate, the license-holding organizations of the "Semáforo" brand, giving rise to legally established responsibilities and such actions may be pursued through administrative, civil, commercial, or criminal actions, as appropriate.
6. Responsibility#
Except in cases where the law expressly imposes otherwise, and only to the extent and scope that it does, Fundación Paraguaya de Cooperación y Desarrollo does not guarantee or assume any responsibility for possible damages and losses caused by the use and utilization of the information, data, and services of Poverty Stoplight.
In particular, it is not responsible for:
Damages and losses that may be due to information and/or services provided or supplied by third parties other than Fundación Paraguaya de Cooperación y Desarrollo, whether a provider, collaborator, or licensee.
Possible omissions, losses of information, data, configurations, unauthorized access, or breaches of confidentiality originating from technical problems, communications, or human omissions, caused by users or third parties, or not attributable to Fundación Paraguaya de Cooperación y Desarrollo.
Damages caused by computer attacks or caused by viruses affecting computer programs, communication systems, or equipment used by Fundación Paraguaya de Cooperación y Desarrollo but manufactured or provided/distributed by a third party.
7. Modifications#
Fundación Paraguaya de Cooperación y Desarrollo reserves the right to unilaterally modify, at any time and without prior notice, any clause or point of these Terms and Conditions of Use. Therefore, it is recommended to periodically check them.
8. Notifications#
All notifications, requirements, requests, and other communications that the user wishes to make to Fundación Paraguaya de Cooperación y Desarrollo, owner of Poverty Stoplight, must be made in writing to the postal address and phone or email contact indicated at the beginning of these Terms and Conditions of Use.
9. Applicable Legislation and Competent Jurisdiction#
These Terms and Conditions of Use are entered into under the laws of Paraguay. Likewise, the user and Fundación Paraguaya de Cooperación y Desarrollo agree to submit any dispute arising from the execution of this agreement or related to it, its interpretation, validity, or invalidity, to the jurisdiction of the Courts and Tribunals of the city of Asunción, Paraguay, expressly waiving any other jurisdiction that may correspond to them.
